When Justice Souter announced his coming retirement, Judge Sonia Sotomayor was the immediate favorite to fill the opening. So, what scandalous details about her past have already been dug up?
 A recent piece by Jeffrey Rosen called Sotomayor "kind of a bully on the bench" and implied she wasn't the brightest bulb on the bench. "Her opinions, although competent, are viewed by former prosecutors as not especially clean or tight, and sometimes miss the forest for the trees," his New Republic piece claims. "Some former clerks and prosecutors expressed concerns about her command of technical legal details." ABC points out that some of the claims Rosen made about her opinions, however, actually amounted to errors on his part.
 Another reason we should be fighting about Sotomayor: This shocking YouTube video in which she acknowledges that many people believe appeals courts set policy. She says in the video that she isn't "promoting it or advocating it," but that hasn't stopped some from labeling her an activist judge who legislates from the bench
